These Terms and Conditions (hereinafter the “Terms“) govern the rights and obligations between WOOD-Břežany Ltd., with registered office at Břežany 241, 671 65 Břežany, Company ID: 05273790, registered in the Commercial Register maintained by the Regional Court in Brno, Section C, File 75606 (hereinafter the “Seller“), and any natural or legal person placing an order via the website https://woodbrezany.com (hereinafter the “Customer“).

These Terms form an integral part of the contract concluded between the Seller and the Customer (hereinafter the “Contract“) and apply to all orders placed through the woodbrezany.com website, including wood pellets, briquettes, firewood, sawdust, wood chips, charcoal, and wood shavings.

1. General Provisions

1.1. Sales via the woodbrezany.com website are available to both consumers as defined under § 2165 et seq. of the Czech Civil Code (hereinafter “consumers“) and business customers purchasing goods for business purposes.
1.2. These Terms are publicly accessible on the woodbrezany.com website in the [“Terms and Conditions”] section.
1.3. The Seller undertakes to supply goods in accordance with these Terms, applicable legislation, and the nature of the products.

2. Product Information and Pricing

2.1. All product details (including specifications, properties, certifications, images, and prices) are published on woodbrezany.com and are deemed accurate and up to date.
2.2. Prices are stated in Czech koruna (CZK) and include VAT at the standard rate of 21%, unless otherwise specified. Prices do not include shipping, which varies based on delivery method and order weight.
2.3. The Seller reserves the right to modify prices at any time without prior notice, though the price applicable is the one in effect at the time the Customer submits the order.
2.4. All products are 100% biomass-based, sourced from local, sustainably managed forests, and comply with European standards (e.g., ENplus A1 for pellets, DINplus for briquettes).

3. Contract Conclusion

3.1. Orders are placed via woodbrezany.com as follows:

The Customer selects products and adds them to the shopping cart.
The Customer provides contact and delivery details.
The Customer selects delivery and payment methods.
The Customer confirms the order by submitting the order form.

3.2. Upon submission, the Customer receives a confirmation email summarising the order and next steps. This email is not a contract confirmation but an acknowledgment of receipt.
3.3. The Contract between the Seller and the Customer is concluded upon dispatch of the order confirmation email (the “order confirmation email”), in which the Seller confirms acceptance of the order and begins preparing goods for dispatch.

4. Payment

4.1. Available payment methods include:

Bank transfer
Online card payment (via secure payment gateway)
Cash on delivery (available with selected carriers only)

4.2. Goods are dispatched only after full payment has been received, unless otherwise agreed (e.g., for business customers).
4.3. Late payments incur statutory penalties, including interest and recovery costs.

5. Delivery and Goods Acceptance

5.1. Available delivery methods include:

Zásilkovna / Czech Post (for parcels up to 30 kg)
DHL / GLS (for parcels and pallets)
Own transport (for palletised and bulk orders)

5.2. Delivery fees depend on weight, volume, and destination country and are displayed in the cart during checkout.
5.3. Delivery typically takes 3–7 working days from order confirmation. For large orders (e.g., pallets), delivery times may be agreed individually.
5.4. Risk of loss or damage passes to the Customer upon receipt of the goods from the carrier.
5.5. The Customer must inspect goods upon delivery and immediately report any damage to both the carrier and the Seller.

6. Complaints and Warranty

6.1. The Customer may file a complaint for defective goods in accordance with Czech Act No. 634/1992 Coll., on Consumer Protection, and the Civil Code.
6.2. The warranty period for biomass fuels is 24 months from the date of receipt.
6.3. Complaints must be submitted by email or post to the Seller’s contact details above and must include:

Customer’s name and address
Description of the defect
Copy of purchase confirmation (invoice or order email)

6.4. The Seller will resolve complaints within 30 days. If a complaint is upheld, the Seller will, at its discretion, replace the goods, issue a refund, or provide a discount.
6.5. Non-compliant items include natural wood characteristics (e.g., colour variation, moisture within declared limits, presence of bark), provided the product meets published specifications.

7. Right of Withdrawal (Consumers Only)

7.1. Consumers may withdraw from the contract without giving a reason within 14 days of receiving the goods.
7.2. Withdrawal must be submitted in writing (e.g., by email or registered post) to the Seller’s contact address.
7.3. Goods must be returned unopened, in original condition, and in undamaged packaging within 14 days of notifying the Seller of withdrawal.
7.4. The Seller will refund payment within 14 days of receiving the returned goods or proof of postage.
7.5. Return shipping costs are borne by the Customer, unless the goods are faulty.
7.6. The right of withdrawal does not apply to goods sealed for health or hygiene reasons that become unsuitable for resale once opened (e.g., opened bags of sawdust or wood chips).

8. Liability

8.1. The Seller is not liable for indirect damages (e.g., lost profits, costs of alternative heating) arising from the use of the goods.
8.2. The Seller does not guarantee uninterrupted website availability due to maintenance or force majeure.
8.3. The Customer agrees not to provide false or misleading information during registration or ordering.

9. Storage of Contractual Records

9.1. The Seller does not store full contract texts online. The order confirmation email serves as the contractual record.
9.2. Invoices are issued electronically and sent by email or post upon request.

10. Final Provisions

10.1. These Terms supersede all prior written or oral agreements between the parties.
10.2. In the event of a dispute, the parties agree to seek an amicable resolution first.
10.3. Disputes between the Seller and consumers are governed by Czech law, with jurisdiction granted to the Znojmo District Court.
10.4. The Seller is registered with the Czech Trade Inspection Authority and complies with all consumer protection laws.
10.5. These Terms may be amended at any time. Updated versions will be published on the website and apply only to contracts concluded after the effective date.
